The Commercial Chamber of Cour de cassation handed down on 8 November 2017 an important judgment on the topic of pre-judgment interest (no. 16-13.307). It stipulates that “the judge must ensure full compensation of harm by estimating damages at the time when they occurred, and granting interest until the day of the judgment” (in French: “le juge doit assurer la réparation intégrale du préjudice en l’estimant au jour où il s’est réalisé et en l’actualisant au jour de sa décision”).
